Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”, “user”) and Yukta AI LLC, (“GolfWiz”, “we”, “us”, or “our”) governing your access to and use of the GolfWiz AI mobile applications, websites, and related services (collectively, the “Service”), available on iOS, Android, and web platforms.
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Relationship With Platform Providers
These Terms are concluded solely between you and GolfWiz, and not with Apple Inc., Google LLC, or any of their affiliates (collectively, “Platform Providers”). GolfWiz, and not the Platform Providers, is solely responsible for the Service and its content.
Your use of the Service must comply with all applicable platform terms, including but not limited to the Apple Media Services Terms and Conditions and the Google Play Terms of Service.
Apple Inc and Google LLC, or any of their affiliates are not responsible for addressing any claims by you or any third party relating to the Service or your possession and use of the Service.
2. License Grant and Scope of Use
Subject to your compliance with these Terms, GolfWiz grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial use:
- On Apple-branded devices that you own or control, as permitted by Apple’s usage rules (including Family Sharing where applicable)
- On Android devices that you own or control, as permitted by Google Play usage rules
All rights not expressly granted are reserved by GolfWiz.
3. Subscriptions and Payments
Certain features of the Service require payment and are offered as auto-renewable subscriptions.
- Subscription length and pricing are displayed at the time of purchase
- Payment will be charged to your Apple ID or Google Play account upon confirmation
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You can manage or cancel subscriptions through your platform account settings
Pricing and billing are governed by the Platform Provider through which you subscribed.
Nothing in this section limits any consumer rights that may not be waived under applicable law.
4. Maintenance and Support
GolfWiz is solely responsible for providing maintenance and support for the Service, as required by applicable law.
Platform Providers have no obligation whatsoever to provide any maintenance or support services with respect to the Service.
5. Warranties and Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple or Google, as applicable, and Apple or Google will refund the purchase price, if any, paid for the Service. To the maximum extent permitted by law, Apple and Google will have no other warranty obligation whatsoever, and any claims relating to the Service are the sole responsibility of GolfWiz.
6. Product Claims and Liability
You acknowledge that GolfWiz, not the Platform Providers, is responsible for addressing any claims relating to the Service, including:
- Product liability claims
- Claims that the Service fails to comply with applicable laws or regulations
- Claims arising under consumer protection, privacy, or similar laws
Nothing in these Terms limits liability beyond what is permitted under applicable law.
7. Intellectual Property Rights
GolfWiz retains all right, title, and interest in and to the Service and its content. In the event of any third-party claim that the Service infringes intellectual property rights, GolfWiz, not the Platform Providers, will be solely responsible for the investigation, defense, settlement, and discharge of such claims.
8. Legal Compliance and Export Controls
You represent and warrant that:
- You are not located in a country subject to U.S. government embargo or designated as a terrorist-supporting country
- You are not listed on any U.S. government list of prohibited or restricted parties
You agree to comply with all applicable export control and sanctions laws.
9. Third-Party Services and Terms
The Service may integrate or rely on third-party services. You agree to comply with all applicable third-party terms when using the Service. GolfWiz is not responsible for third-party services.
10. Termination
GolfWiz may suspend or terminate your access to the Service at any time for violation of these Terms. Upon termination, your license to use the Service will immediately cease.

12. Third-Party Beneficiaries
You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS version of the Service, and that Apple has the right to enforce these Terms against you as a third-party beneficiary. Similar rights apply to Google LLC for the Android version where applicable.
Upon your acceptance of these Terms, Apple is deemed to have accepted its rights as a third-party beneficiary.
Apple and Google do not assume any responsibility for the enforcement of these Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.
Nothing in this section limits any consumer rights that may not be waived under applicable law.
If you reside outside the United States, mandatory local consumer protection laws may apply.
14. Changes to These Terms
GolfWiz may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
